Utah SSI Denial at 18 — How to Appeal and Request Reconsideration

The Age-18 Denial Is Common — and Appealable

When a childhood SSI recipient turns 18, the Social Security Administration reviews their case under adult disability standards. The evaluation shifts from childhood functional limitations to whether the individual can perform Substantial Gainful Activity — earning more than $1,690 per month in 2026.

The denial rate at this stage is significant. Many individuals who qualified under the childhood standard do not automatically meet the stricter adult criteria, at least on paper. But a denial at this stage is not final. The appeal process exists specifically because initial determinations often miss critical evidence.

The 60-Day Window

From the date you receive the denial notice, you generally have 60 days to request reconsideration. This is not a soft deadline. Missing it means starting the entire application process over from scratch — a new claim with new wait times.

If you elect benefit continuation and file within 10 days of receiving the notice, SSI payments can continue during the appeal. Filing between day 11 and day 60 preserves your appeal rights but does not continue benefits during the review.

File within 10 days whenever possible.

How to Request Reconsideration

The reconsideration request goes directly to the Social Security Administration. You can:

• File online at ssa.gov using the Request for Reconsideration form (SSA-561)
• Call your local SSA field office and request that they initiate the reconsideration
• Visit the field office in person with your documentation

The reconsideration is a paper review by a different examiner at Utah's Disability Determination Services (DDS). The new examiner reviews the original evidence plus any additional documentation you submit.

Strengthening the Appeal

The most common reason for an age-18 denial is insufficient medical evidence documenting how the disability prevents work. The childhood record often focuses on educational impact rather than vocational capacity.

Evidence that strengthens a reconsideration:

• Updated medical evaluations from adult providers documenting current functional limitations
• Psychological testing performed within the last 12 months
• Detailed statements from teachers, therapists, and job coaches describing the individual's functional capacity in workplace-like settings
• Vocational assessments from the IEP transition plan or Utah State Office of Rehabilitation
• Daily living documentation — a detailed description of what the individual can and cannot do independently, written by someone who observes them regularly

The standard is whether the individual can sustain competitive employment. Evidence showing they need constant supervision, cannot manage time independently, or cannot follow multi-step instructions without support directly addresses the SGA question.

Beyond Reconsideration

If the reconsideration is also denied, the next step is requesting a hearing before an Administrative Law Judge (ALJ). This hearing is where most successful appeals are decided — the ALJ can ask questions, hear testimony, and evaluate evidence that a paper reviewer might have weighed differently.

Protecting Medicaid During the Appeal

The 10-day benefit-continuation window applies to SSI payments, not automatically to Medicaid. Because Utah is an SSI Criteria state, contact DWS promptly to ask whether coverage continues and whether a separate Medicaid appeal is required.
