Idaho SSI Appeal After Age 18: How to Fight a Redetermination Denial

The Two Deadlines You Cannot Miss

When the SSA determines that your child no longer qualifies for SSI under adult criteria, the cessation notice triggers two separate clocks. Confusing them costs families money and Medicaid coverage.

10 days: benefit continuation. If you file a Request for Reconsideration within 10 days of receiving the cessation notice, SSI cash payments can continue at the current rate throughout the appeal process. If your child is already a Medicaid participant, Idaho permits Medicaid to continue for an SSA disability appeal filed within 60 days of the SSA decision; for existing DD Waiver services, separately notify DHW within 10 days of the waiver notice to request continuation. For anyone not already covered, Idaho requires a separate Medicaid application. The SSA assumes you received the notice five days after the postmark date — so the actual filing window is about 15 days from the postmark.

Miss this window and SSI cash payments may stop, even if you still file an appeal within the second deadline. Medicaid is handled separately under Idaho's appeal rules, so do not assume that it stops or continues automatically.

60 days: filing the appeal itself. You have 60 days from receiving the cessation notice to file a Request for Reconsideration (Form SSA-789-U4). The same five-day receipt rule applies. After 60 days, the appeal right is gone unless you can demonstrate good cause for late filing — a standard the SSA applies strictly.

The practical strategy: file on day one. Don't spend time gathering additional medical records before filing. You can submit supplemental evidence after the appeal is filed.

How to File a Request for Reconsideration

You can file in person at the Boise, Idaho Falls, Twin Falls, Pocatello, or Lewiston SSA field offices, by calling 1-800-772-1213, or online through ssa.gov. The form asks why you disagree with the decision and gives you space to explain what medical evidence the SSA should consider.

When writing the appeal:

Focus on functional limitations, not diagnoses. The SSA already has the diagnosis. What they need is evidence that the condition prevents your child from performing substantial gainful activity — any work that exists in the national economy, not just their preferred job. Describe specific daily limitations: can't maintain a schedule without prompting, can't manage medication independently, requires supervision to safely prepare meals.

Submit everything you have. Updated medical records, psychological evaluations, therapist notes, IEP progress reports, teacher observations, supported employment reports — anything that documents functional limitations under adult criteria. The Disability Determination Services (DDS) examiner in Idaho will review all submitted evidence.

Request a consultative examination if medical records are thin. If your child hasn't seen a specialist recently, the DDS may order a consultative examination at no cost. You can also request one by explaining which functional domains lack adequate documentation.

What Happens During Reconsideration

The DDS assigns a different examiner — someone who did not make the original decision. They review all existing evidence plus any new documentation you submitted. The examiner may contact your child's doctors or schedule a consultative exam.

Most reconsiderations take 3-6 months. During this period (if you filed within the 10-day window), SSI payments can continue. Medicaid continuation is governed separately under Idaho rules.

If the reconsideration is favorable, benefits continue without interruption. If it's unfavorable, you receive a new denial letter and can request a hearing before an Administrative Law Judge (ALJ).

The ALJ Hearing: When to Get an Attorney

The ALJ hearing is the level where most SSI cases are won. Nationally, about 45% of ALJ hearings result in a favorable decision — significantly higher than the reconsideration approval rate. The hearing is conducted in person or by video, and you have the right to bring an attorney or representative.

Idaho SSI hearings are scheduled through the Office of Hearings Operations (formerly the Office of Disability Adjudication and Review). Wait times vary — expect 6-18 months between requesting a hearing and the hearing date.

At this stage, most families benefit from retaining a disability attorney. Attorneys who handle SSI cases typically work on contingency — they're paid from back benefits if you win (capped at 25% of back pay or $9,200, whichever is less) and collect nothing if you lose. The attorney's value is in presenting evidence strategically and cross-examining vocational and medical experts.

Protecting Medicaid While the Appeal Is Pending

If you filed the appeal within 10 days and elected benefit continuation, SSI can stay active while the appeal is pending. If your child already receives Medicaid, Idaho's separate appeal rules can preserve that coverage; for existing DD Waiver services, separately request continuation from DHW within 10 days of the waiver notice. Otherwise, apply to DHW under the ABD pathway. But if you missed the 10-day window, or if the appeal ultimately fails, you need a backup plan.

Apply for ABD Medicaid through Idaho DHW independently. An SSI denial does not automatically disqualify your child from state Medicaid. DHW makes its own disability determination, and the standard is the same — inability to engage in substantial gainful activity due to a medical impairment. File through idalink.idaho.gov or call 1-877-456-1233.

File the DD Waiver application separately. The Liberty Healthcare functional assessment that determines DD Waiver eligibility operates independently of the SSA's medical determination. Your child can be denied SSI and still meet the Intermediate Care Facility level of care for the DD Waiver.

One denial does not close every door. The programs operate under different agencies with different review processes.
