How to Appeal an SSI Denial at Age 18 in Colorado

An SSI denial at the age-18 redetermination feels like the floor dropped out. Your child had benefits for years, and now the SSA says they no longer qualify under the adult standard. Here's the thing most families don't realize immediately: a denial is not the end, and you can keep benefits running while you fight it.

The 60-Day Appeal Window

After the SSA issues a denial, you generally have 60 days after receiving it to file a Request for Reconsideration. SSA generally presumes receipt 5 days after the notice date unless you show otherwise.

File online at ssa.gov, by phone at your local SSA office, or in person. Online is faster and creates an immediate paper trail.

Continuation of Benefits: The 10-Day Rule

This is the single most important deadline in the appeal process. If you file the reconsideration and request continuation of benefits within 10 days after receiving the denial notice (SSA generally presumes receipt 5 days after the notice date), SSI payments may continue throughout the appeal. If you miss that 10-day window, you can still appeal within 60 days, but continuation of benefits is not automatic; follow the instructions in the notice.

Continuation of benefits also preserves the automatic Health First Colorado (Medicaid) link. If payments stop, the automated system may trigger a Medicaid termination, and you'll need to file a separate Medicaid application through PEAK to maintain healthcare coverage.

The trade-off: if you lose the appeal, the SSA will seek to recover the benefits paid during the continuation period as an overpayment. You can request a waiver if repayment would cause hardship, but the potential overpayment obligation is real.

The Four Levels of Appeal

The SSA disability appeal process has four levels:

  1. Reconsideration — A different SSA examiner reviews the same evidence, plus any new evidence you submit. Denial rates at reconsideration are high, but this step is required before you can request a hearing.

  2. Hearing before an Administrative Law Judge (ALJ) — This is where most successful appeals are won. You'll testify (or your child will, with support), and the ALJ can question you directly. The hearing format and location will be identified in the SSA notice.

  3. Appeals Council review — If the ALJ denies, you can request the Appeals Council in Falls Church, VA review the decision. They can deny review, remand for a new hearing, or issue their own decision.

  4. Federal court — A last resort filing in U.S. District Court.

Strengthening Your Appeal in Colorado

The most common reason for an age-18 denial is that the SSA found insufficient evidence that the disability prevents SGA. The adult standard is work-focused, so your appeal evidence should be too:

  • Vocational assessments from the school district's transition program or Colorado's Division of Vocational Rehabilitation (DVR)
  • Adaptive behavior evaluations showing limitations in daily living, communication, and community functioning
  • Provider statements from psychiatrists, neurologists, or therapists who can speak to functional limitations in workplace-relevant terms
  • Work history or failed work attempts — if the individual tried to work and couldn't maintain employment, document why
