Utah Special Education Age 22 Exit — When Do Services End?

The question most families ask when their child enters a post-high transition program — "exactly when does this end?" — has an answer that depends entirely on a birthday. Utah's age-22 exit rules under Administrative Code R277-419 use precise calendar cutoffs, and misunderstanding them can cost a student an entire year of services.

The Two Exit Windows

Utah does not use a simple "services end when you turn 22" rule. Instead, R277-419 establishes two exit windows based on where the student's birthday falls in the calendar year:

September 2 through December 31 birthday: Special education services terminate at the beginning of the college or district winter holiday recess in the calendar year the student turns 22.

January 1 through September 1 birthday: Services terminate at the end of the fiscal year (June 30) in the calendar year the student turns 22.

This means a student born on March 15 who turns 22 in 2028 would lose eligibility on June 30, 2028. A student born on October 10 who turns 22 in 2028 would lose eligibility at the start of winter break in December 2028.

The Enrollment Eligibility Check

The critical enrollment question comes the year before exit. Under Utah's pupil accounting rules:

• If a student is 21 years old as of July 1 of the upcoming school year, they are eligible to enroll for that entire school year
• If a student has already turned 22 on or before July 1, they are no longer eligible to enroll

This is the practical trigger. A student who turns 22 in May will not be eligible to enroll for the school year that begins in August. A student with a September 2 through December 31 birthday (for example, October 10) will have been enrolled in August and continue through the beginning of winter recess.

What Triggers the Exit

Two events terminate FAPE (Free Appropriate Public Education) eligibility in Utah:

1. Graduating with a regular high school diploma — this ends FAPE immediately, regardless of age. An alternate diploma or certificate of completion does not end FAPE.
2. Reaching the age-22 cutoff — determined by the birthday-based rules above.

Once either trigger fires, the school district's obligation to provide special education and transition services ends permanently. There is no re-enrollment path after a regular diploma or an age-out.

What the School Must Provide at Exit

When a student exits — whether by graduation or aging out — the school district must provide a Summary of Performance (SOP). This document summarizes the student's academic achievement and functional performance and includes specific recommendations for accommodations the student will need in postsecondary education, employment, or independent living. Parents should push for the SOP to be detailed enough that adult service providers (DSPD caseworkers, VR counselors, postsecondary disability offices) can use it as a functional baseline.

Planning Around the Exit Date

The gap between the last day of school services and the first day of funded adult services is where families get hurt. DSPD waivers operate on a needs-based waitlist — there is no guarantee of immediate funding when school ends. Vocational Rehabilitation can take 60 days just to determine eligibility. SSI redetermination at age 18 is a separate process entirely.

Families should plan backward from the exit date:

• Two years before exit: Confirm DSPD intake is complete and the student is on the waitlist. Report any changes in needs to update the NAQ score.
• One year before exit: Verify VR application is submitted and an IPE is in development. Confirm the decision-making framework (SDMA, guardianship, POA) is in place.
• Six months before exit: Request the SOP process begin. Confirm all adult service applications are active.
