The Durable-by-Default Rule

Since January 1, 2018, every power of attorney executed in Wyoming is durable by default. Under W.S. § 3-9-104, this means the agent's authority survives the principal's subsequent incapacity — it stays in effect even if your child later loses the cognitive ability to manage their own affairs.

Before 2018, families had to explicitly include durability language. Now, Wyoming law assumes durability unless the document specifically states it's non-durable. This is a significant protection for families of young adults with progressive conditions or unpredictable cognitive changes.

What a Financial POA Covers

A Durable Financial Power of Attorney under the Wyoming Uniform Power of Attorney Act (W.S. §§ 3-9-101 to 3-9-403) lets your adult child appoint you to manage banking, sign contracts, pay bills, handle government benefit applications, manage real property, and conduct other financial transactions on their behalf.

The POA can be broadly worded to cover all financial matters, or narrowly drafted to limit authority to specific areas — just banking, just benefit management, just lease agreements. The scope is controlled by the document's language, not by the court.

It can take effect immediately upon signing or be structured as a "springing" POA that activates only upon a written determination of incapacity. Under W.S. § 3-9-109(c)(i), if the POA doesn't specify who determines incapacity, a licensed physician or psychologist must provide a written certification.

Execution Requirements

The requirements are straightforward. Under W.S. § 3-9-105, the document must be:

  • Written — no oral POAs
  • Signed by the principal (your child), or signed by another person in the principal's conscious presence at their direction
  • Acknowledged before a notary public

No witnesses are required for a financial POA in Wyoming — just the principal's signature and notarization. This is simpler than healthcare directives, which require either notarization or two witnesses.

The Capacity Threshold

Your child needs sufficient capacity at the moment of signing to understand the document's purpose and the powers they're delegating. This is a lower threshold than the cognitive ability required for complex financial management — a person who can't balance a checkbook may still understand "I'm authorizing my mother to handle my banking."

If there's any question about capacity, get a clinical evaluation before execution. A written assessment documenting that your child understood the POA at the time of signing is strong protection against future challenges.

POA vs. Guardianship: When Each Applies

A Durable Financial POA is the right choice when your child has enough capacity to sign, you need authority over financial matters, and the relationship is cooperative. It's private (no public court records), flexible (can be modified or revoked at any time), free to create, and imposes zero ongoing reporting requirements.

Court-ordered guardianship or conservatorship becomes necessary when your child cannot understand what a POA is, when third parties refuse to honor the POA, or when your child is vulnerable to signing conflicting documents or being exploited by others. The court order carries legal weight that cannot be revoked by the ward.
