West Virginia Guardianship Annual Reporting Requirements

Guardianship Does Not End at the Hearing

Once a West Virginia circuit court appoints you as guardian or conservator, you take on ongoing obligations that last for as long as the appointment remains in effect. These are not optional — failure to comply can result in contempt of court, removal from your appointment, or both.

The Initial Compliance Window

Within 30 days of the appointment order, you must:

• File the Oath of Appointment (Form GC14) — a formal promise to fulfill your fiduciary duties
• Secure any required surety bond (Form GC18) — generally required for conservators unless a statutory exception applies; the amount considers the protected person's estate and income
• Complete the state-mandated guardian education program and file the Affidavit Certifying Completion of Mandated Education (Form GC11)

If you are also appointed conservator, you must file a complete Inventory (Form GC32) within 60 days of the appointment. This inventory lists all real and personal property, bank accounts, investments, income sources, and debts of the protected person. Within 14 days of filing the inventory, you must mail copies to all parties who received notice of the original petition.

Annual Guardian Reports (Form GC31)

Every year, a guardian must file the Periodic Report of Guardian (Form GC31) with the circuit court that issued the original appointment. This report covers the protected person's:

• Physical health and medical condition
• Mental and emotional well-being
• Living situation and residential placement
• Educational or vocational activities
• Social interactions and community involvement
• Any changes in the protected person's needs or capacity

The report gives the court a picture of how the protected person is doing and whether the current level of guardianship remains appropriate. If the person's capacity has improved, the court may consider modifying the order.

Annual Conservator Accountings (Form GC30)

A conservator must file the Accounting of Conservator (Form GC30) annually. This is a detailed financial statement covering:

• All income received on behalf of the protected person
• Every expenditure made from the estate
• Changes in asset values
• Bank statements and investment records
• Any debts incurred or paid

The accounting is reviewed by a court-appointed Fiduciary Commissioner, who audits the figures and reports to the judge. This is a genuine audit — the commissioner can question expenditures, request supporting documentation, and flag irregularities.

The Mandated Education Requirement

The guardian education program is a one-time requirement, not an annual obligation. The program covers the guardian's legal duties, the rights of the protected person, reporting requirements, and ethical obligations. You must complete it and file the GC11 affidavit within 30 days of appointment.

Some counties offer the education program through the circuit court or local legal aid organizations. Others accept completion of approved online programs. Check with your county's Circuit Clerk for the accepted options.

What Happens If You Fall Behind

If you miss a reporting deadline, the court can:

• Issue a show cause order requiring you to appear and explain the delay
• Appoint a Fiduciary Commissioner to investigate
• Remove you as guardian or conservator and appoint a replacement
• Hold you in contempt of court

In practice, courts in West Virginia often send reminder notices before escalating, but relying on reminders is risky. Setting calendar reminders for your annual filing dates is the simplest way to stay compliant.

Reducing the Burden

If the ongoing reporting obligations feel disproportionate to your child's situation — particularly if the conservator accounting is burdensome for a small estate — consider whether the conservatorship is actually necessary. Many families find that a Representative Payee designation (for SSI/SSDI) and a WVABLE account handle the financial side without the court oversight. A limited guardianship over personal decisions only, without conservatorship, eliminates the annual financial accounting requirement entirely.
