Student Earned Income Exclusion for SSI in Wyoming

What the SEIE Does

The Student Earned Income Exclusion (SEIE) is a federal SSI work incentive that allows students under 22 who are regularly attending school to shelter a significant portion of their earned income from SSI's income counting rules. Without the SEIE, after the applicable $20 general and $65 earned-income exclusions, the remaining countable earnings reduce the SSI check by 50 cents per dollar. With it, students can exclude up to $2,410 per month in 2026 before any of that month's earnings affects their SSI payment, subject to the annual cap.

The annual cap is $9,730 for 2026, meaning the exclusion is available until the year's excluded earnings reach that ceiling. Once the cap is reached, normal SSI income counting resumes for the rest of the calendar year.

Who Qualifies

The SEIE applies to SSI recipients who are:

• Under age 22
• Regularly attending school — this includes public or private school, college or university, a vocational or technical training course, or a home-study program approved under applicable state or local law. A Wyoming Division of Vocational Rehabilitation (DVR) program such as Pre-Employment Transition Services (Pre-ETS) may count only if it meets SSA's qualifying training or school-attendance rules.

The "regularly attending" standard requires the student to be enrolled for at least 8 hours per week in a college or 12 hours per week in grades 7-12, or participating in a training course for at least 12 hours per week. Reduced attendance due to the student's disability still qualifies as regular attendance if the school verifies the reduced schedule is appropriate.

How It Interacts With Other Income Rules

The SEIE applies before any other earned income exclusions. Here is the order SSA uses to calculate countable earned income for an SSI recipient:

1. Subtract the SEIE (up to $2,410/month in 2026, if eligible)
2. Subtract the $20 general income exclusion (if not already used against unearned income)
3. Subtract the $65 earned income exclusion
4. Divide the remainder by 2 (the 50% earned income disregard)

The result is the countable earned income that reduces the SSI check dollar-for-dollar.

For a student earning $1,500 per month, the SEIE wipes out the entire amount. Countable earned income is zero, and the full $994 SSI payment continues unchanged. Without the SEIE, that same $1,500 in earnings would reduce the SSI check by roughly $707.50.

Why It Matters for Transition Planning

The SEIE creates a window of opportunity during the transition years. A student who is 18, still attending school, and working part-time through a DVR-supported job placement can earn meaningful income while keeping their full SSI check and — critically — their automatic Wyoming Medicaid enrollment. This is the period when families should be building work experience, employment skills, and savings (directed into a WYABLE account to stay under the $2,000 resource limit) before the student graduates and loses SEIE eligibility.

Once the student exits school, the SEIE disappears. Earned income starts reducing SSI after the applicable $20 general and $65 earned-income exclusions, with the remainder divided by two.
