Graduation as a Change of Placement
Under federal IDEA regulations and South Dakota administrative rules, awarding a student with an IEP a regular high school diploma constitutes a change of placement. This matters because a change of placement triggers specific procedural safeguards — the same protections that apply when a district wants to move a student to a different classroom setting or remove them from services entirely.
The most important safeguard is prior written notice. Before the school district can graduate your child and terminate their special education eligibility, they must provide you with a formal written document explaining what they're proposing, why they're proposing it, and what other options were considered. This isn't a courtesy — it's a legal requirement.
If your child receives a regular, unmodified high school diploma, their right to a Free Appropriate Public Education (FAPE) ends immediately. No more IEP services, no more transition programming, no more related services. That's why the prior written notice exists: to give you time to review the decision and exercise your rights if you disagree.
What Prior Written Notice Must Include
South Dakota follows the federal IDEA requirements for prior written notice content. The notice must contain:
- A description of the action the school proposes (graduating the student and terminating FAPE)
- An explanation of why the school is proposing the action
- A description of the evaluation data, assessment results, or records the school used to support the decision
- A statement that you have procedural safeguards and how to obtain a copy of the safeguards notice
- Sources you can contact for help understanding the notice (such as South Dakota Parent Connection or Disability Rights South Dakota)
- A description of any other options the IEP team considered and why those were rejected
The notice must be provided in your native language or primary mode of communication, and it must arrive with enough time for you to review it and respond before the action takes effect.
The Critical Distinction: Standard Diploma vs. Modified Pathway
This is where many South Dakota families get caught off guard. The prior written notice and change-of-placement rules only apply when the student is receiving a regular, unmodified high school diploma — one earned by completing all standard state and local graduation requirements using only accommodations, not modifications.
Under ARSD 24:05:27:12, the IEP team can modify specific units of credit toward graduation requirements to accommodate a student's disability. If the student's course of study was modified — meaning learning expectations were lowered or content was substituted — the student receives a modified regular diploma rather than an unmodified regular diploma and remains eligible for special education services through the end of the fiscal school year in which they turn 21 (June 30).
Here's the practical difference:
Standard diploma (unmodified courses): FAPE ends immediately upon graduation. The school must issue prior written notice of this change of placement. The student exits the system.
Modified pathway or alternative certificate: FAPE continues. The student can access 18–21 community-based transition programs. No change of placement occurs because services aren't being terminated.

What to Do If You Receive the Notice
When the school sends prior written notice that they intend to graduate your child, you have several options:
Review the graduation requirements carefully. Ask the IEP team directly: did your child complete all standard graduation requirements using only accommodations? Or were any courses modified? If courses were modified, the student receives a modified regular diploma rather than an unmodified regular diploma, and the school cannot terminate FAPE.
Check the Summary of Performance. South Dakota requires the school to complete a Summary of Performance (SOP) for any student exiting special education through graduation or aging out. The SOP documents the student's academic and functional levels and provides recommendations for adult service providers. If you haven't seen a draft SOP, ask for one before agreeing to graduation.
Verify adult services are in place. Before accepting a diploma that ends FAPE, confirm that adult service applications are submitted and moving forward — SSI redetermination at age 18, Division of Developmental Disabilities intake through Dakota at Home, Division of Rehabilitation Services enrollment. A gap between school exit and adult services is exactly what the transition plan is designed to prevent.
Exercise your procedural safeguards. If you believe the school is prematurely graduating your child or the prior written notice is inadequate, you can request mediation, file a written state complaint with the South Dakota DOE, or request a due process hearing. These options exist specifically for situations where you disagree with a proposed change of placement.
