South Dakota IEP Diploma vs Certificate: How the Graduation Decision Affects Services

The graduation decision is one of the highest-stakes choices in a South Dakota IEP, and many families don't realize they're making it until it's already been made for them. Whether your child receives a standard diploma, a modified diploma, or an alternative certificate determines exactly when their right to free special education services ends — and that timeline difference can span years.

South Dakota's Graduation Pathways

South Dakota issues one regular high school diploma, but the IEP team has authority under ARSD 24:05:27:12 to modify the specific credits required for graduation. That modification creates meaningfully different outcomes:

Standard Regular Diploma (Unmodified): The student completes all state and local graduation requirements — minimum 22 credits — using only accommodations, not modifications to content or expectations. Receiving this diploma ends FAPE eligibility immediately. It constitutes a formal change in placement, which requires the school to issue Prior Written Notice.

Modified Regular Diploma: The student receives a diploma, but the IEP team modified course content or lowered learning expectations — for example, substituting functional math for Algebra I. This diploma does not end FAPE. The student can continue receiving transition services through June 30 of the fiscal year in which they turn 21.

Alternative Certificate: The student has not met graduation requirements but receives a certificate to participate in the graduation ceremony with peers. FAPE continues until maximum age eligibility.

Maximum Age Exit (Aging Out): The student turns 21 and exits at the end of that fiscal year without completing standard requirements. FAPE ends automatically on June 30.

Why This Matters More Than Most Families Realize

The critical distinction is between the first pathway and everything else. An unmodified standard diploma is the only exit that immediately terminates all special education eligibility. Every other pathway preserves the student's right to continue receiving transition services, including access to 18–21 community-based transition programs, vocational training, and independent living instruction.

A resource room teacher can deliver modified content, but the course only counts toward standard graduation if the teacher holds state certification for that specific content area. Modifications that lower rigor may also restrict future college admission and require remedial coursework at postsecondary institutions.

Five Questions to Ask Before Accepting a Diploma

Before agreeing to graduation at any IEP meeting, ask the team:

1. Did the student complete requirements using only accommodations, or were expectations modified?
2. If requirements were modified, does the family understand that accepting this diploma does not end FAPE — and that the student has the right to continue services until 21?
3. Does the Summary of Performance accurately document the student's functional needs?
4. Are adult service systems (CHOICES or Family Support 360 waivers, DRS vocational rehabilitation) active and funded, or will there be a gap?
5. Has the school provided the required Prior Written Notice of change in placement within a reasonable timeframe?

The Strategic Consideration

For students who need more time developing vocational skills or independent living capacity, a modified diploma pathway opens the door to continued school-based support. It also gives families additional years to get through the adult waiver interest list — which currently carries a 1-to-2-year wait in South Dakota.
