Filing Without an Attorney in Maryland

Maryland law allows any interested person to file a guardianship petition without hiring an attorney. The reported base filing fee is $165 when self-represented, compared with a reported base fee of $185 when filing through counsel. Local county surcharges may apply, so confirm the current total with the Clerk's Office. The court's guardianship forms are available free from the Maryland Judiciary website, and the process follows the same rules whether you have a lawyer or not.

That said, filing pro se means you are responsible for every procedural step: gathering clinical certificates, completing the correct forms, arranging personal service on the alleged disabled person, and presenting evidence at the hearing. The court will not coach you through the process or overlook missed requirements.

The Forms You Need

All Maryland guardianship forms use the CC-GN prefix and are available at the Maryland Judiciary's guardianship forms page. The core set for a petition:

• CC-GN-002 — Petition for Guardianship of Alleged Disabled Person
• CC-GN-019 — Physician's Certificate (or CC-GN-020 for Psychologist, CC-GN-021 for LCSW-C). Effective October 1, 2026, these consolidate into a single Guardianship Capacity Assessment form under a redesigned CC-GN-019
• CC-GN-010 — Affidavit of Good Faith Search (to document your efforts to locate and notify all interested parties)
• CC-GN-005 or CC-GN-006 — Notice to Interested Persons (Person or Property, depending on which guardianship type you are seeking)

After appointment, you will also need:

• CC-GN-011 — Inventory and Information Report (due within 60 days)
• CC-GN-013 — Annual Report of Person (due annually within 60 days of your appointment anniversary)
• CC-GN-012 — Fiduciary's Account (for property guardianship)

The Clinical Certificate Requirement

This is where pro se filers most often stumble. You must submit two clinical certificates from licensed professionals. At least one of the required examinations must have occurred within 21 days before filing. The examiners can be two physicians, or one physician plus one psychologist, LCSW-C, or nurse practitioner.

Schedule the examinations early and coordinate with both clinicians on timing. Make sure at least one examination falls within the 21-day window before filing; if neither does, obtain a current examination before filing.

Fee Waiver

If the filing fee is a hardship, file Form CC-DC-089 (Request for Waiver of Costs) with your petition. The court evaluates eligibility based on income and expenses. If approved, the $165 base filing fee is waived entirely.

Several organizations provide free guardianship assistance to Maryland families who cannot afford an attorney:

Maryland Legal Aid serves low-income residents statewide. Eligibility is means-tested based on federal poverty guidelines, which excludes many middle-class families. But if you qualify, they can represent you in the guardianship proceeding itself — not just help with forms.

Disability Rights Maryland is the federally designated Protection and Advocacy agency. They provide self-help resources, sample forms, and guidance on supported decision-making alternatives that might eliminate the need for guardianship altogether.

Tips for Pro Se Filers

Organize before you file. Assemble copies of any existing powers of attorney, advance directives, or supported decision-making agreements. The court wants to see that you have considered less restrictive alternatives before seeking guardianship.

Complete the orientation video. The Maryland Judiciary requires all prospective guardians to watch an online orientation before appointment. Complete it early so it does not delay your case.

Track every deadline. After filing, you need to arrange personal service on the individual and certified mail to all interested parties. Missing service deadlines can push your hearing back by weeks.

Prepare for the hearing. Even in an uncontested case, you will need to present your evidence to a judge. Bring the clinical certificates, your petition, and be ready to explain why guardianship is necessary and why less restrictive alternatives are insufficient.
