Kentucky Special Education Services Until 21: FAPE, Graduation, and the Exit Timeline

Your child's IEP guarantees a free appropriate public education under federal law — but that guarantee has an expiration date. In Kentucky, FAPE extends through age 21, and the exact rules around when it ends determine whether your family has months or years of transition planning still available.

How Long FAPE Lasts in Kentucky

Under 707 KAR 1:290, Kentucky provides special education services to eligible students through the end of the school year, subject to this rule: if your child turns 21 on or after August 1, they can finish that entire academic year. If they turn 21 before August 1, their eligibility ends with the prior school year.

This creates a significant difference depending on birthday timing. A student born in September who turns 21 in September 2027 can attend through May 2028. A student born in June who turns 21 in June 2027 loses eligibility at the end of the 2026–2027 school year.

The Graduation Cliff

Here's the part many families miss: earning a regular high school diploma immediately terminates FAPE — regardless of age. A student who graduates at 18 with a standard diploma loses all school-based services, therapies, transportation, and structured programming the moment that diploma is conferred.

Kentucky House Bill 562 (signed April 2026) created the Alternate High School Diploma and Modified High School Diploma specifically to address this. Students on alternate or modified diploma tracks receive a formal graduation credential without forfeiting their right to continue services through age 21. The alternate and modified diplomas take effect starting the 2027–2028 school year.

If your school district attempts to graduate your child with a regular diploma and you believe they still need transition services, you have the right to file for mediation or a due process hearing. Under IDEA's stay-put rule, the school cannot terminate services while the dispute is pending.

What the Summary of Performance Covers

When a student exits — whether by graduation or aging out — the school must provide a Summary of Performance (SOP). This document captures the student's academic achievement levels, functional performance, and recommendations for supports the adult will need after school ends.

The SOP is the bridge between the school system and adult agencies. The Kentucky Office of Vocational Rehabilitation (OVR) uses it to shape the Individualized Plan for Employment. Medicaid waiver case managers reference it when determining service intensity. Without a thorough SOP, families spend months recreating documentation that the school was required to compile.

Planning Before the Clock Runs Out

The transition from school-based services to adult systems does not happen automatically. Kentucky's Medicaid waiver waitlists average nearly eight years for the SCL waiver. OVR operates under an Order of Selection with restricted priority categories. SSI requires an independent adult redetermination at age 18.

Each of these processes has its own timeline, and none of them coordinate with the school's exit date. The gap between leaving school and receiving adult services is where families lose the most ground.

Starting at your child's age-14 ARC meeting, every transition plan update should include a checkpoint: which adult agencies have been contacted, which applications are pending, and which services are confirmed for the day after school ends.
