707 KAR 1:320 and Kentucky Transition Services: What the Regulation Requires

If you're trying to figure out what Kentucky schools are actually required to do for transition planning, the answer lives in 707 KAR 1:320. This Kentucky Administrative Regulation translates federal IDEA requirements into state-specific rules — and in several important areas, Kentucky goes beyond the federal floor.

The Age-14 Trigger

Federal IDEA requires transition planning to begin no later than the IEP that is in effect when the student turns 16. Kentucky accelerates this. Under 707 KAR 1:320, the ARC must address transition service needs beginning in the student's eighth-grade year or when the student reaches age 14, whichever comes first.

This isn't optional — it's a regulatory requirement. If your child's eighth-grade ARC meeting didn't include a transition service needs statement focused on the student's course of study, the IEP does not meet this transition-planning requirement.

What the ARC Must Include

Starting at age 14, 707 KAR 1:320 requires the IEP to contain:

• A statement of the student's transition service needs, focused on the student's course of study
• Beginning at age 16 (or earlier if the ARC determines it appropriate), measurable postsecondary goals based on age-appropriate transition assessments covering education or training, employment, and where appropriate, independent living
• The transition services needed to assist the student in reaching those goals
• A statement that the student was invited to the ARC meeting where transition was discussed

The regulation also requires the school to obtain signed prior written consent before inviting outside agency representatives — such as an OVR counselor or a Community Mental Health Center case manager — to the ARC. Without that consent, adult agency staff are legally barred from attending.

704 KAR 3:305 and Graduation

Graduation requirements are governed by a separate regulation: 704 KAR 3:305. This regulation establishes the credit and assessment requirements for a regular high school diploma. What matters for transition planning is the interaction between graduation and FAPE:

Earning a regular high school diploma terminates FAPE immediately. The school has no further obligation to provide special education services. Kentucky House Bill 562 (signed April 2026) created the Alternate High School Diploma and Modified High School Diploma to address this — students on these tracks receive a formal credential without losing their right to services through age 21.

Transfer of Rights

707 KAR 1:340 Section 6(11) governs the transfer of educational decision-making rights at age 18. The school must provide written notice to both the student and parent at least one year before the student's 18th birthday. Once the student turns 18, all IDEA rights transfer to them unless a court has appointed a guardian.

Kentucky does not have a statutory supported decision-making framework, but the KDE Determination of Educational Representative form allows an adult student to formally delegate educational decision-making back to a parent or trusted adult.

Using the Regulations in Practice

Knowing these citation numbers matters when you're in a disagreement with the school. If the ARC team says transition planning starts at 16, you can point to 707 KAR 1:320 and the age-14 trigger. If the school says your child must graduate because they've completed credit requirements, you can reference the distinction between a regular diploma (terminates FAPE) and the alternate diploma pathway (preserves it).
