The Rule That Shuts People Out

Neighboring states often use a two-standard-deviation threshold for adaptive functioning; West Virginia requires three. That difference can exclude applicants who might qualify under less restrictive criteria elsewhere.

Three standard deviations below the mean corresponds to a standard score of 55 or below on most adaptive behavior instruments, placing the individual below the first percentile. A score of 63-68 — which represents a clear and documented functional impairment — falls between two and two-and-a-half standard deviations and does not meet West Virginia's threshold. Individuals with diagnoses like Level 2 Autism or Mild Intellectual Disability are often denied medical eligibility when their scores do not meet the threshold.

What Gets Tested

Under BMS Provider Manual Chapter 513, the applicant must demonstrate substantial deficits in at least three of six major life areas. Each is assessed using approved standardized instruments:

Self-care: Vineland-3 or ABAS-3 composite scales. Requires a standard score of 55 or below, or scaled sub-domain scores of 1 or 2.

Language and communication: Receptive or expressive standard scores of 55 or below. Assessed using the CASL or Vineland-3 communication composites.

Learning (functional academics): Standard achievement scores of 55 or below on the WRAT-5 or WIAT-4.

Mobility: Motor skills standard scores of 55 or below on the Vineland-3 Motor Skills Domain or specialized physical therapy assessments.

Self-direction: Standard score of 55 or below on the ABAS-3 Self-Direction Scale or corresponding Vineland-3 sub-scales.

Capacity for independent living: Must show substantial deficits in at least three of six sub-domains — Home Living, Social, Employment, Health/Safety, Community, and Leisure — with scaled scores of 1 or 2.

How the Evaluation Works

After submitting the IDD Waiver application (Form WV-BMS-IDD-01) to Acentra Health, you receive a packet listing approved psychologists from the Independent Psychologist Network (IPN). You have exactly 14 calendar days to select a psychologist and return the selection form — miss that deadline and Acentra closes the application.

The psychologist conducts the Independent Psychological Evaluation (IPE) using the standardized instruments above. The completed evaluation goes to Psychological Consultation and Assessment (PC&A), which serves as the state's Medical Eligibility Contracted Agent (MECA). PC&A reviews the psychometric scores and clinical narratives to determine whether the applicant meets the Intermediate Care Facility for Individuals with Intellectual Disabilities (ICF/IID) level of care.

What to Do If You're Denied

A medical denial from the MECA is not the end. Under BMS Provider Manual Chapter 900, you have 30 days from the adverse notice to submit a written request for administrative review to the Bureau for Medical Services. If the review affirms the denial, you have another 30 days to request a formal evidentiary hearing before the BMS Commissioner.

This hearing is where psychometric evidence can be challenged — arguing that a Vineland-3 sub-domain score was improperly administered, that clinical narratives were not weighted appropriately alongside test scores, or that the evaluator failed to account for behavioral factors that suppressed test performance.
