South Carolina IEP Meeting Rights for Parents

Your Core Rights at the IEP Meeting

IDEA guarantees parents specific rights at every IEP meeting, and South Carolina's implementation of those rights includes a few state-specific details worth knowing before you sit down at the table.

Equal participation. You are a full member of the IEP team, not a guest. The school cannot hold an IEP meeting without notifying you and making reasonable efforts to ensure you can attend. If you cannot attend in person, the district must offer alternative participation methods — phone, video conference, or rescheduling.

Prior Written Notice. Whenever the school proposes or refuses to initiate or change the identification, evaluation, educational placement, or provision of FAPE, it must provide you with a Prior Written Notice (PWN). This document must explain what the district is proposing or refusing, why, what data it used, what other options it considered and rejected, and your procedural safeguards. If the district refuses your request at an IEP meeting but doesn't issue a PWN, request one in writing. The failure to provide PWN is itself a procedural violation.

Procedural safeguards notice. The district must provide a copy of your procedural rights at least once per year, and upon request at any time. This document explains your rights to evaluate, to consent, to disagree, to file complaints, and to request due process. In South Carolina, the SCDE publishes a standard procedural safeguards document that districts must use.

Bringing an Advocate or Attorney

Under IDEA, parents have the right to bring any individual with "knowledge or special expertise regarding the child" to the IEP meeting. That includes professional advocates, attorneys, family members, therapists, or anyone else you believe will contribute to the discussion.

IDEA allows parents to invite individuals with knowledge or special expertise regarding the child. Tell the district in advance who you plan to bring and ask about its local participation policy so the meeting can be conducted without an avoidable dispute.

If you bring an attorney, the school may choose to have its own attorney present. This often shifts the tone of the meeting from collaborative to adversarial. Consider whether having your attorney attend the meeting itself — versus reviewing documents before and after — better serves your goals.

Recording the Meeting

South Carolina does not have a state law that specifically addresses audio or video recording of IEP meetings. The LEA may require, prohibit, or regulate recording through its local policy. If a policy prohibits or limits recording, it must include exceptions necessary for a parent to understand the IEP process or to ensure IDEA rights, including when a disability affects participation.

If you want to record, notify the district in advance and ask for its written recording policy. Do not assume that silence in the policy means recording is permitted; request the district's position in writing.

Recording has a practical benefit beyond legal protection: it creates an objective record of what was discussed and agreed upon. IEP meeting notes prepared by the school are not verbatim transcripts and may not capture everything that was said.

Inviting Outside Agencies

For students with transition plans (age 13 and older in South Carolina), you have the right to request that the school invite representatives from outside agencies that may be responsible for providing or paying for transition services. With your written consent, the school must send the invitation.

The most common outside agency to invite is SCVRD. Having a vocational rehabilitation counselor at the IEP meeting allows the transition plan to reflect realistic VR service timelines and coordinate Pre-ETS with school-based transition activities. SCVRD's participation is particularly valuable during the years leading up to graduation, when the formal VR application and Individualized Plan for Employment should align with the IEP's post-secondary goals.

If your child is registered with BHDD-OIDD and has an assigned case manager, inviting that person can help coordinate waiver service planning with the school transition timeline. The school system and the waiver system don't automatically share information, so an IEP meeting may be the only setting where both service plans are discussed together.

What Happens When Rights Are Violated

If the district commits a procedural violation — holding a meeting without proper notice, failing to provide PWN, refusing to invite an outside agency you requested, or making a placement decision without your input — you have several options:

Informal resolution. Contact the special education director and state the specific violation in writing. Many procedural issues resolve when the district realizes the error has been documented.

State complaint. File a complaint with the South Carolina Department of Education. The state must investigate and issue a decision within 60 calendar days. State complaints are effective for documented procedural violations because the state reviews the record — it doesn't require you to argue the case yourself.

Mediation. Request mediation through the SCDE. Mediation is voluntary, free, and conducted by a trained mediator. Any agreement reached in mediation is legally binding.

Due process hearing. The most formal option. You file a due process complaint, and the case is heard by an impartial hearing officer. This is where having an attorney becomes critical.
