Oklahoma Guardianship Cost: Filing Fees, Attorney Fees, and Hidden Expenses
Court Filing Fees by County
Oklahoma guardianship filing fees are set by each county's district court, and they vary. Here are the fees for the counties where most families file:
Oklahoma County: $204.14 for adult guardianship. Relative guardianship petitions receive a discount, reducing the fee to approximately $137 (a $67 reduction). The filing is handled through the Oklahoma County Court Clerk's probate division.
Tulsa County: Approximately $175 for standard adult guardianship filings, with some variation depending on supplemental motions.
Cleveland County, Canadian County, and Payne County each set their own fee schedules, typically falling in the $150 to $210 range for adult guardianship petitions. Call the Court Clerk's office before filing to confirm the current amount — fees change periodically without much advance notice.
If the filing fee is a barrier, Oklahoma law provides relief. Under Title 28, Section 152, families can file an In Forma Pauperis (pauper's affidavit) to request a waiver of court costs. The court reviews income and asset information to determine eligibility.
Attorney Fees
For families who hire a private special needs or elder law attorney, the cost of a guardianship case depends heavily on whether it is contested:
Uncontested relative guardianship (no one disputes the guardianship or the proposed guardian): $1,500 to $3,000 for most Oklahoma City and Tulsa attorneys. This covers petition drafting, filing, the hearing, and post-appointment paperwork.
Moderately complex cases (some family disagreement, or the young adult has assets that require a property management plan): $3,000 to $5,000.
Contested guardianship (a family member objects, or the proposed ward contests the guardianship through their attorney or Guardian ad Litem): $5,000 to over $10,000. Contested cases proceed to a formal trial with rules of evidence, witness cross-examination, and potentially multiple hearing dates.
Rural families face an additional practical cost: the limited number of special needs attorneys outside the Oklahoma City and Tulsa metros often means travel expenses or working with an attorney remotely.
Mandatory Additional Expenses
Beyond the filing fee and any attorney costs, every Oklahoma guardianship petition involves several non-optional expenses:
OSBI Background Check: The proposed guardian and all adult household members over 18 must complete an OSBI criminal background check. Confirm the required search type and current fee with the court or attorney.
Medical Evaluation: The court requires a written evaluation from a licensed physician or psychologist documenting the proposed ward's incapacity. If the young adult's most recent psychological evaluation is outdated or does not specifically address functional capacity in terms the court recognizes, a new evaluation will cost $300 to $1,500 depending on the provider and complexity.
Guardian ad Litem (GAL): If the proposed ward does not have an attorney, the court must appoint independent counsel or a GAL to represent their interests. In some counties, the GAL's fees are absorbed by the court system. In others, the petitioner may be ordered to pay the GAL's costs, which can range from $200 to $1,000 or more.
Publication Costs: Some counties require publication of the guardianship notice in a local newspaper. This typically runs $50 to $150.
Surety Bond: If the guardianship includes authority over the ward's property (guardianship of the property), the court generally requires the guardian to post a bond. The bond amount is based on the ward's intangible personal property and the court's order, and the annual premium is usually 1% to 2% of the bond amount.

Ongoing Annual Costs
Guardianship does not end at the hearing. Oklahoma law requires annual reporting, and each report carries its own compliance costs:
- Annual Report on the Guardianship of the Person must be filed, notarized, and served on all interested parties
- Annual Report of the Property (if the guardian manages finances) must include a detailed accounting of all income, expenses, and asset changes
- Interested parties have 15 days from the filing date to submit written objections to the court
Families who use an attorney for annual report preparation typically pay $500 to $1,500 per year. Pro se filers avoid this cost but must invest significant time in understanding the reporting requirements.
How to Reduce Costs
The most direct way to reduce guardianship costs is to determine whether guardianship is actually necessary. Oklahoma law under Title 30, Section 3-111 requires courts to evaluate less restrictive alternatives before granting a guardianship. These alternatives — supported decision-making agreements, durable powers of attorney, healthcare proxies, and representative payee arrangements — cost little or nothing to establish and avoid the ongoing annual reporting expenses entirely.
The Oklahoma Adult Guardianship & Alternatives Guide helps families work through this evaluation systematically, with decision worksheets that compare each option against their young adult's specific needs. For families who determine that guardianship is the right path, it includes a complete pro se filing manual that can eliminate attorney fees for uncontested cases.
