Can a Non-Citizen Be Appointed Guardian in New York?

- Background clearance — the State Central Register search (Form OCFS-3909) is one of the documents used in some guardianship filings
- Stability — the court wants evidence that you plan to remain in the jurisdiction
Immigration categories can present different practical questions, so families should get individualized legal advice before relying on a proposed appointment.
Complications for Temporary Visa Holders
If you hold a temporary visa or have another immigration-status concern, ask counsel how a possible change in your availability would affect your court-ordered duties and any backup arrangement.
For an adult Article 17-A case, ask the Surrogate's Court about the standby-guardian procedure under SCPA § 1757. A standby guardian is appointed by the court upon application. After the death, renunciation, or adjudication of incompetency of the guardian, the standby may assume the duties immediately without further proceedings, subject to court confirmation within 180 days. SCPA § 1726 addresses standby guardians for infants, not this adult process.

If the ward is eligible for SSI, a non-guardian may still need SSA's separate representative-payee appointment to manage those federal benefits; a power of attorney does not by itself make someone a representative payee.
