Louisiana Interdiction Curator Duties: Bonds, Annual Accounting, and Undercurator Oversight

Being Named Curator Is an Ongoing Legal Obligation

Winning an interdiction judgment isn't the end of the process — it's the beginning of a permanent set of legal duties. Once the court appoints you as curator, you're bound by strict fiduciary obligations under continuous court supervision. Missing a deadline or failing an accounting can result in personal liability, removal, and even criminal referral.

Oath, Bond, and Inventory

Immediately after the court signs the interdiction judgment, you must:

Take an oath of office — filed with the Clerk of Court, affirming that you will faithfully manage the interdict's affairs in their best interest.

Post a fiduciary bond — the bond amount is typically tied to the total value of the interdict's estate. If the only income is SSI ($994/month in 2026) and the interdict has no significant assets, many parish judges will waive the bond requirement. But when the interdict has real property, savings, or receives a retroactive Social Security payment, expect the court to require a bond equal to or exceeding the estate's value. Surety bond premiums typically run 1–3% of the bond amount annually.

Compile a detailed property inventory — within the timeframe set by the court, you must file a sworn, itemized inventory of every asset the interdict owns: bank accounts, real property, vehicles, personal property, benefit payments, and any debts owed to or by the interdict.

Annual Financial Accounting

This is the obligation most curators underestimate. Under Louisiana law, you must file comprehensive annual financial accountings with the court, documenting:

• All income received on the interdict's behalf (SSI, SSDI, DAC benefits, trust distributions, any earnings)
• Every expenditure made from the interdict's funds, with receipts or documentation
• Current account balances and asset values
• Any changes to the interdict's property (sales, transfers, new acquisitions)

These accountings are formal court filings, not informal summaries. Many curators hire an accountant or attorney to prepare them, adding $500–$1,500 annually to the cost of maintaining the interdiction.

Personal Status Reports

Beyond the financial accounting, the curator must also file periodic reports on the interdict's personal well-being:

• Current living situation and housing conditions
• Physical and mental health status
• Medical treatments and changes in care
• Social activities and community participation
• Any incidents or concerns about the interdict's safety

The Undercurator's Watchdog Role

The court must appoint an independent undercurator in every interdiction case. Under La. C.C.P. art. 4565, the undercurator's job is to:

• Review every annual financial accounting and personal report filed by the curator
• Approve or disapprove transactions that require undercurator concurrence
• Notify the court of any fiduciary failures, financial irregularities, or concerns about the interdict's welfare
• Act as a check on the curator's power — the undercurator may move to appoint a successor if the curator becomes disqualified, the office terminates, or the curator violates Article 4566

The court appoints the qualified person best able to fulfill these duties. The undercurator qualifies by taking an oath to discharge the office's duties.

What Happens If You Don't Comply

Failing to file annual accountings, missing bond payments, or mismanaging the interdict's assets can result in:

• Court-ordered surcharges (personal liability for mismanaged funds)
• Removal as curator and replacement with a professional curator at your expense
• Contempt of court findings
• Criminal prosecution for financial exploitation in egregious cases
