Why Louisiana's Checklist Is Longer Than Other States

Every state has an age-18 disability transition. Louisiana's is uniquely complicated because the state's civil law system adds steps that don't exist anywhere else. Continuing tutorship — the streamlined legal authority mechanism — has a hard deadline before the 18th birthday. Forced heirship laws mean estate planning isn't optional. The OIDD tiered waiver system runs on a needs-based scoring tool, not a first-come-first-served list. And because Louisiana is a Section 1634 state, SSI and Medicaid eligibility are permanently linked.

Missing one step doesn't just delay things — it can close a window permanently (continuing tutorship), cost thousands of dollars (forced into interdiction), or cut off healthcare coverage (SSI-linked Medicaid termination).

This checklist organizes every critical action by the age it needs to happen.

Age 14–15: Early Planning Window

Transition IEP initiation: Under IDEA and Louisiana Bulletin 1706, formal transition planning must be integrated into the student's IEP beginning no later than age 16. Starting conversations at 14–15 gives the team time to assess post-secondary goals, career pathways, and support needs.

OIDD registry intake: Contact your Local Governing Entity (LGE) to begin the intake process for the OIDD system. This establishes the child's "protected date" on the Request for Services Registry — a date that serves as a tie-breaker within urgency categories when waiver slots open. The earlier you register, the earlier the protected date.

Evaluate continuing tutorship eligibility: Review the child's most recent cognitive testing. Continuing tutorship requires documented IQ of approximately 67 or below. If the most recent evaluation is outdated, request a new one through the school system or a private psychologist. The filing window opens at age 15.

Age 16: Transition IEP and LRS

Transition IEP with measurable post-secondary goals: The IEP must now include specific, measurable goals for post-secondary education, vocational training, independent living, and community participation.

LRS referral: Request that the school's transition specialist initiate a referral to Louisiana Rehabilitation Services. LRS delivers Pre-Employment Transition Services (Pre-ETS) through cooperative agreements with school systems — job exploration, work-based learning, post-secondary counseling, workplace readiness, and self-advocacy instruction. Pre-ETS is available to students aged 16–21 with an active IEP or 504 plan.

Evaluate graduation pathway: Consider whether the TOPS University Pathway, Jump Start Career Pathway, or the April Dunn Act (individual performance criteria for graduation) is the best fit. This decision affects both the diploma the student earns and how long they remain in the school system.

Age 17–17.5: Legal Authority and Benefit Preparation

File continuing tutorship petition: This is the highest-stakes deadline. Gather the psychological evaluation, submit records to the parish coroner for concurrence, retain a Louisiana attorney, and file the petition in district court. The judge must sign the decree before the child's 18th birthday. Starting at 17 gives a comfortable margin; starting after 17.5 leaves dangerously little time for delays.

Prepare for SSI redetermination: If the child is currently receiving SSI, gather adult-standard clinical evidence — treating specialist records, functional limitation documentation, daily care logs. The age-18 redetermination evaluates under the adult disability definition (ability to engage in substantial gainful activity), which is stricter than the childhood standard.

Prepare first SSI application (if newly eligible): If parental deeming previously disqualified the child from SSI, prepare the application materials so you can file on or near the 18th birthday when deeming ends.

File child support extension motion: If a child support order is in place, file the contradictory motion under La. R.S. 9:315.22.1 to extend support past 18 for a disabled adult child. This must be filed before the 18th birthday.

Estate planning review: Consult a Louisiana special needs attorney to ensure wills direct the forced-heirship portion into a third-party special needs trust. Without this, a mandatory inheritance will disqualify the adult child from SSI and Medicaid.

Age 18: The Transition Month

Respond to SSI redetermination: If the cessation notice arrives, file Form SSA-561 (Request for Reconsideration) within 10 days of receiving it to maintain benefit continuation. The 60-day appeal deadline preserves appeal rights but doesn't preserve payments during the review.

Apply for representative payee status: File Form SSA-11-BK at your local SSA field office to be appointed as representative payee for the adult child's SSI benefits. The continuing tutorship judgment does not grant this authority — SSA requires its own appointment.

Submit new SSI application (if newly eligible): With parental deeming eliminated, file the SSI application. Bring documentation of the child's own income and resources (which must be under $2,000) and medical evidence meeting the adult disability standard.

Request SUN screening from OIDD: If the child is on the Request for Services Registry and approaching the service cliff (loss of school-based supports), contact your LGE to request a Screening for Urgency of Need assessment. Document all unmet support needs, caregiver health concerns, and risk factors — the SUN score determines waiver priority.

Consider supported decision-making: If continuing tutorship isn't in place and the adult child has sufficient cognitive capacity, execute a Supported Decision-Making Agreement under the Dustin Gary Act. The agreement must be written and notarized by a Louisiana notary public.

Age 19–21: Extended School and Waiver Transition

Maximize the age-22 education extension: Louisiana's FAPE provisions allow students with disabilities to remain in the school system through age 22. This period provides continued access to Pre-ETS, transition services, and structured programming that the adult system may not replicate.

Transition from Children's Choice to adult waiver: If the child holds a Children's Choice Waiver, coordinate with the OIDD Support Coordinator to transition to an appropriate adult waiver (Supports, ROW, or NOW) before school exit.

Open ABLE account: With the disability onset documented before age 46 (met for all childhood-onset disabilities), open a Louisiana ABLE account. The 2026 standard annual contribution limit is $20,000. ABLE accounts exclude up to $100,000 from SSI's $2,000 resource limit — creating meaningful savings capacity.

LRS vocational planning: Continue working with LRS on the Individualized Plan for Employment. If the individual will need long-term supported employment after school exit, coordinate the handoff from LRS to OIDD waiver-funded follow-along services.

Age 22: School Exit

Finalize education: The student exits the public school system. All school-based supports — including Pre-ETS, related services, and transition programming — terminate.

Complete LRS-to-OIDD employment handoff: LRS provides up to 90 days of job development and intensive coaching to stabilize the worker. After stabilization, long-term follow-along support transfers to the OIDD waiver. The assigned Support Coordinator must write employment objectives into the Comprehensive Plan of Care before LRS closes its case.

Verify all benefit protections are in place: SSI active, Medicaid confirmed, representative payee appointed, legal authority established (tutorship, interdiction, or SDM), trust funded, ABLE account open, waiver services authorized. Any gap at school exit becomes significantly harder to close once the school system's institutional support disappears.
