How to Prepare for SSI Redetermination at 18 in West Virginia
The Standard Changes Completely
Childhood SSI looks at whether a child has "marked and severe functional limitations" compared to typically developing peers. Adult SSI asks a fundamentally different question: is the person unable to engage in Substantial Gainful Activity (SGA) because of a medically determinable impairment? Building the Evidence File
The strongest redetermination cases rely on medical evidence that directly addresses the ability to work, not just the presence of a diagnosis. SSA's Disability Determination Section — operating in Charleston and Clarksburg — evaluates five sequential questions:
- Is the applicant working above SGA level?
- Is there a medically determinable impairment?
- Does the impairment meet or equal a listed condition?
- Can the applicant perform past relevant work?
- Can the applicant perform any other work in the national economy?

Current medical evaluations — not just the diagnosis, but functional limitations. A letter from a treating physician that says "John has autism" is far less useful than one that says "John requires verbal prompting for every task transition, cannot follow multi-step instructions without visual supports, and requires continuous supervision in any setting with more than two other people."
Psychological and neuropsychological testing — standardized scores from the Vineland-3, ABAS-3, or WAIS provide the objective data SSA's examiners need. Scores in the adaptive behavior domains (self-care, communication, independent living) directly address the work-capacity question.
Therapy and behavioral health records — documentation of ongoing treatment, intervention frequency, and functional progress (or lack thereof) demonstrates the severity and persistence of the impairment.
Using IEP Records as SSI Evidence
Your child's IEP history is a powerful evidence source that many families underutilize. The documents that carry the most weight include:
- Triennial evaluation reports with standardized testing scores
- IEP present levels of performance documenting academic, social, and behavioral functioning
- Transition assessments showing vocational aptitude testing and functional skill evaluations
- Behavioral Intervention Plan data tracking frequency and intensity of behavioral episodes
- Related services logs showing the level of support required (speech therapy hours, occupational therapy, paraprofessional assignment)
The key is translating educational language into work-capacity language. SSA does not care that your child reads at a third-grade level. They care that your child cannot read work instructions, safety signs, or employment contracts — and that the IEP data proves it.

Timing Your Preparation
SSA typically sends the redetermination warning letter up to one year before the child's 18th birthday. Use that time to:
- Request copies of all IEP records from the school district — they are legally required to provide them under FERPA
- Schedule updated evaluations with treating providers, specifically requesting that they address work capacity
- Compile a chronological file of every medical, psychological, and educational document
- Establish representative payee status (Form SSA-11-BK) if your child cannot manage their own finances
