What the Health Care Proxy Actually Does

On your child's 18th birthday, HIPAA locks you out of their medical care. Doctors cannot share diagnoses, discuss treatment plans, or accept your consent for procedures — even if your adult child lives at home and you drive them to every appointment. The New York health care proxy form is the fastest legal tool to restore that access.

Governed by Public Health Law Article 29-C, a health care proxy lets your adult child (the "principal") name you as their health care agent. If a physician later determines your child lacks decision-making capacity for a specific medical situation, the proxy activates and you can consent to or refuse treatment on their behalf.

The form itself is one page, available free from the New York State Department of Health in multiple languages. No notary is required — just two adult witnesses who are not the designated agent.

Who Has the Capacity to Sign One

The capacity threshold for executing a health care proxy is lower than most families expect. Your adult child does not need to understand complex medical terminology or weigh treatment alternatives in advance. They need to grasp one concept: that they are choosing a specific person to make medical decisions for them if they cannot.

A young adult with an intellectual or developmental disability who can identify their parent and express that they want that parent to help with doctor decisions may meet this standard. Capacity is individual; if there is any doubt, a brief conversation with the treating physician can confirm capacity before signing.

This matters because it means many young adults who lack the contractual capacity for a durable power of attorney (which requires understanding the scope and consequences of delegating financial control) can still validly execute a health care proxy.

How to Complete the Form

The DOH health care proxy form has five sections:

Section 1 — Your child writes (or someone writes for them) the name and contact information of the person they are appointing as agent. That person is typically a parent.

Section 2 — Optional instructions or limitations on the agent's authority. Most families leave this blank, which grants the agent broad authority over all medical decisions. If your child has specific wishes about life-sustaining treatment, document them here.

Section 3 — Optional alternate agent in case the primary agent is unavailable. Naming a second parent, older sibling, or trusted family member provides backup coverage.

Section 4 — Duration. The proxy remains in effect indefinitely unless your child specifies an expiration date or revokes it. Most families do not set an expiration.

Section 5 — Signatures. Your child signs (or makes their mark) and two adult witnesses sign, confirming they observed the principal's signature. Neither witness can be the named agent.

When the Proxy Activates

A common misconception is that signing the proxy immediately transfers medical authority. It does not. The proxy sits dormant until a physician determines that your adult child lacks decision-making capacity for the specific treatment decision at hand. Once that determination is made, you step in as agent.

If your child regains capacity — even temporarily — their own decisions override yours. The proxy reactivates only if capacity is lost again.

For young adults with stable intellectual disabilities, activation typically happens at the first medical situation where the treating physician documents that the patient cannot understand the proposed treatment well enough to give informed consent.

Health Care Proxy vs. Guardianship

Many families assume they need guardianship to handle their child's medical care after 18. For medical decisions alone, a health care proxy achieves the same result with none of the court involvement, none of the cost, and no loss of your child's other civil rights.

A health care proxy does not cover financial decisions, educational advocacy, or housing choices. If your child needs support in those areas, you may combine a proxy with a supported decision-making agreement or a durable power of attorney, depending on their capacity level.

If your child cannot understand the concept of appointing an agent at all, a health care proxy is not available. Common Mistakes to Avoid

Waiting until a medical crisis. Complete the form while everyone is calm and your child can sign without pressure. Hospital staff can witness a proxy in an emergency, but the process is far more stressful.

Having the agent serve as witness. If the person you are naming as agent also signs as a witness, the form is invalid.

Forgetting to give copies. After signing, give copies to your child's primary care physician, any specialists, the hospital where they receive care, and the named agent. The original stays with your child.
