What the Law Requires

For family guardians and guardian advocates, Florida's standard requirement is an 8-hour educational course covering the duties, responsibilities, and legal framework of guardianship. This applies to family guardians under Chapter 744 and guardian advocates under Chapter 393, but the court may waive the requirement or impose additional education case-by-case.

The course must be completed within four months after appointment. A local court may require proof earlier or impose additional requirements. Check your circuit's local administrative orders, because showing up to a hearing without the certificate when the judge expects it can mean a continuance.

What the Course Covers

The training walks through the legal and practical framework you'll operate within:

• Florida guardianship statutes: The key provisions of Chapter 744 and Chapter 393, including the difference between guardianship of the person and property
• Duties and responsibilities: What you're required to do as guardian or guardian advocate — from filing the Initial Plan to annual reporting
• Rights of the ward: What rights the ward retains and your obligation to consult them in decisions
• Financial management: Inventory requirements, accounting standards, and fiduciary obligations (particularly relevant if you'll manage property)
• Reporting requirements: Annual plans, Physician's Reports, and how to file them with the clerk

For guardian advocates who manage only person-related decisions (not property), much of the financial content won't directly apply to your situation. But the course covers it anyway because the court needs assurance that you understand the full scope of potential obligations.

Where to Take the Course

Approved courses are available through several channels:

Circuit court programs. Several judicial circuits offer their own guardian education programs, sometimes at reduced cost or free for family guardians. The 13th Judicial Circuit (Hillsborough) provides free digital packets and educational resources. Contact your local probate division to ask about circuit-sponsored options.

Non-profit organizations. The Florida State Guardianship Association and other advocacy organizations offer approved courses, some of which are available online.

Private providers. Multiple approved private companies offer online courses that you can complete at your own pace. Costs vary — typically $50-$200 for the full course with certificate.

When selecting a course, confirm that it's approved by the Florida courts for guardianship education credit. An unapproved course, no matter how thorough, won't satisfy the requirement.

Timing It Right

Complete the training before you file the petition if your circuit requires it at filing. Even if your circuit accepts post-appointment completion, doing it early has practical benefits: you'll understand the filing requirements, reporting obligations, and scope of authority before you're in front of a judge, which makes the hearing itself smoother.

The standard 8-hour requirement is generally a one-time obligation for a nonprofessional guardian. You don't need to retake it annually unless the court imposes an additional requirement. Professional guardians have separate continuing-education obligations, so verify with your clerk's office if you're unsure.

Circuit-Specific Variations

Not every circuit enforces the training requirement identically:

• A court may waive or add education case-by-case, considering the guardian's experience, education, duties, and the ward's needs
• Local rules may require completion certificates earlier than the four-month statutory period or impose additional filing requirements
• The 19th Judicial Circuit (Indian River/St. Lucie) directs all pro se cases through a specific case manager who may provide additional orientation beyond the standard course
