The Four Things That Change at 18

When your child with a disability turns 18 in Hawaii, four shifts happen simultaneously — and none of them coordinate with each other automatically.

SSI switches to adult rules. SSA stops counting your household income against your child's benefits (parental income deeming ends). But they also evaluate whether the disability prevents your child from engaging in Substantial Gainful Activity; the 2026 SGA amount is $1,690 per month for non-blind individuals. About one-third of childhood SSI recipients lose benefits at this review nationally.

Educational rights transfer. Under IDEA's age-of-majority provisions, all educational decision-making rights transfer from you to your child at 18. Unless you've established a Supported Decision-Making agreement under Hawaii's Act 284, a Power of Attorney, or guardianship, you may no longer have legal authority to attend IEP meetings on their behalf, access their medical records, or communicate with agencies about their case.

Med-QUEST requires a separate application. Hawaii is a 209(b) state — SSI approval does not trigger Medicaid enrollment. Your child needs to file a separate Non-MAGI application through the DHS KOLEA portal (medical.mybenefits.hawaii.gov) with Forms DHS 1100, 1100B, 1127, and 1128.

Adult services replace school services. The IEP's transition plan identifies post-school goals, but the actual adult service agencies — DOH-DDD, DVR, and waiver providers — require their own applications, eligibility determinations, and timelines.

The 12-Month Countdown

6 months before turning 18:

• Schedule a comprehensive psychological evaluation (booking lead times in Hawaii run 8 to 16 weeks, longer on neighbor islands)
• Request updated medical summaries from treating physicians
• Begin researching legal decision-making options: SDM agreement, POA, or guardianship

3 months before turning 18:

• Gather all IEPs, school eligibility reports, and adaptive behavior assessments
• Contact your island's DOH-DDD intake office to request the application packet
• If pursuing guardianship, begin the probate court filing process

Month of 18th birthday:

• File Form SSA-1 with the Social Security Administration for the adult SSI application
• File the Med-QUEST Non-MAGI application through KOLEA the same week
• Sign the DDD Application for Services (starts the 90-working-day submission clock)

Within 90 working days of the DDD application:

• Submit all required clinical evidence to DDD intake
• Complete the DDD intake interview
• DDD has 30 working days after receiving all documents to issue an eligibility determination

What Stays the Same

Your child's IEP continues through graduation or age 22, whichever comes first. The school's responsibility to provide transition services doesn't end at 18 — the transfer of rights changes who makes the decisions, not what services are available.

DVR Pre-Employment Transition Services (Pre-ETS) are available to students with disabilities ages 14 through 21, regardless of the SSI redetermination outcome. If your child is working with a DVR counselor through the school, that relationship can continue.

The Gap Nobody Warns About

The most dangerous period is the 45- to 90-day window between filing for adult SSI and Med-QUEST and receiving approval decisions. During that window, your child may have no health coverage — and if they need therapy, medication, or behavioral health services, the costs are out-of-pocket.

Filing both applications concurrently is the single most important step. Don't wait for SSI approval before starting the Med-QUEST application.
