When the Age-19 Review Triggers

Under WAC 388-823, DDA must conduct a mandatory eligibility review when a client turns 19 if their most recent eligibility determination was completed before their 16th birthday. This affects most individuals who were enrolled in DDA as young children — if your child was found eligible at age 5 and hasn't had a formal redetermination since, the age-19 review is coming.

The review isn't automatic in the sense that DDA just looks at existing records and moves on. They need updated clinical documentation to confirm the individual still meets eligibility criteria as an adult. The childhood evaluation completed at age 5, 8, or 12 won't be sufficient.

What DDA Needs

The documentation requirements mirror the initial DDA application:

• Updated psychological or psychoeducational evaluation with current standardized scores (cognitive testing like WAIS-IV, adaptive behavior assessment like Vineland-3 or ABAS-3)
• Current diagnostic records confirming the qualifying condition (intellectual disability, cerebral palsy, epilepsy, autism, or closely related neurological condition)
• Functional assessments documenting current support needs

If the individual was originally found eligible under a developmental delay category rather than one of the five qualifying conditions, the age-19 review is especially critical. The childhood developmental delay pathway has its own expiration — eligibility now expires on the 20th birthday under emergency rules matching HB 1407.

The Age-20 Cliff

If DDA requests additional information for the age-19 review and the family fails to submit it, eligibility automatically terminates on the individual's 20th birthday.

This deadline catches families who assume DDA will reach out multiple times or that the review is optional. If requested information is not submitted and eligibility terminates, DDA eligibility-based services and CARE access can be disrupted; Community First Choice has separate Apple Health and functional criteria.

The fix: submit updated evaluations at least 60 days before the expiration date. Don't wait for DDA to ask twice.

SB 5394 and the No Paid Services Caseload

Senate Bill 5394, enacted during the 2025 legislative session, directly affects clients on the No Paid Services caseload. The legislation authorizes DDA to provide limited case resource management services to NPS clients to help them identify community supports, but simultaneously limits the scope of optional services available to this caseload.

The practical impact: if you're on the NPS caseload after the age-19 review, DDA is authorized to assign a Case Resource Manager who can help connect you with community resources. But the CRM isn't authorized to provide case management to clients who don't engage with the agency — if you don't respond to outreach, you're classified as "inactive" and DDA stops contact.

For families emerging from the age-19 review still on the NPS list, the immediate priority is requesting a CARE assessment and Community First Choice services. CFC is an entitlement — if you meet the financial and functional criteria, you have a legal right to personal care services regardless of your NPS status.

Preparing for the Review

Start early. At age 17 or 18, request updated psychological and adaptive behavior testing. School districts can conduct evaluations for students with IEPs, or you can arrange private testing, though that may involve out-of-pocket costs.

Use the school evaluation cycle. If the student is due for a triennial IEP evaluation around the same time, coordinate with the school psychologist to ensure the testing meets DDA's requirements — specifically, standardized cognitive and adaptive scores, not just curriculum-based assessments.

Keep copies of everything you submit. DDA's processing can take weeks, and documentation can be misfiled. Having your own copies means you can resubmit quickly if anything goes missing.
