DAC Benefits in Colorado: Disabled Adult Child Benefits Explained
Disabled Adult Child benefits — called DAC or sometimes CDB (Childhood Disability Benefits) — are one of the most misunderstood parts of the adult disability system. They're not SSI. They're not based on your adult child's work history. They're Title II Social Security benefits paid based on a parent's earnings record, and for many Colorado families they're substantially higher than SSI.
What Triggers DAC Benefits
DAC benefits become available when a parent of an adult disabled child retires, becomes disabled, or dies — and three conditions are met:
- The adult child's disability began before age 22
- The adult child is unmarried (with certain exceptions)
- The parent has enough Social Security work credits
The benefit amount is typically 50% of the parent's primary insurance amount if the parent is living (retirement or disability), or 75% if the parent has died. For a parent with a solid work history, this can mean $1,200–$1,800 per month — well above the $994 SSI Federal Benefit Rate.

The critical difference: DAC benefits are not needs-based. There's no $2,000 resource limit. An adult child on DAC can have savings, own property, and build wealth without jeopardizing the benefit — a freedom SSI recipients don't have.
How DAC Interacts with SSI
DAC benefits don't arrive automatically. A parent retiring or passing away doesn't trigger any notification to your family. You have to file a claim with the SSA.
When DAC benefits start, they typically cause SSI to stop. The DAC payment usually exceeds the SSI Federal Benefit Rate, and since SSI is needs-based, the DAC income pushes the individual over the SSI threshold. This creates a critical Medicaid risk that the Section 1634(c) disregard is designed to address.
Here's the sequence that matters:
- Your adult child is receiving SSI
- A parent retires, becomes disabled, or dies
- You file for DAC benefits with the SSA
- DAC payments begin — and SSI payments stop because DAC income exceeds the SSI limit
- The Section 1634(c) disregard protects Medicaid eligibility (but only if SSI was active immediately before DAC started)
That fifth point is the trap. If the parent retires or dies before you've established your adult child on SSI, the 1634(c) protection doesn't apply. This is why establishing SSI eligibility at age 18 — even if you expect DAC benefits later — is non-negotiable.

The Social Security Fairness Act Impact
The Social Security Fairness Act, signed January 5, 2025, repealed the Windfall Elimination Provision (WEP) and Government Pension Offset (GPO) retroactively to January 2024. If your parent worked in a public-sector job that didn't pay into Social Security — teacher, firefighter, police officer — their Social Security benefit is no longer reduced by those provisions. That means the DAC benefit based on their record is now higher than it would have been under the old rules.
If your family was previously told DAC benefits would be minimal because of a parent's government pension, contact SSA to verify the record. If you never applied because of the old offsets, you must file a new claim; it is not automatic. The SSA issued retroactive adjustments starting February 2025.
