2026 Payment Rates by Living Arrangement

California is one of the few states that supplements the federal SSI payment with its own State Supplementary Payment. The combined amount depends entirely on the recipient's living situation:

The difference between independent living and living in a parent's household is $326.07 per month — almost $4,000 per year. That gap exists because the SSA applies the In-Kind Support and Maintenance rule when an adult child lives in someone else's household without paying their proportional share of expenses.

The Rental Rule: Getting the Full Rate While Living at Home

Most transition-age adults with disabilities continue living with their parents after turning 18. If the adult child lives in a parent's household and does not contribute their pro-rata share of household operating expenses, the SSA applies the In-Kind Support and Maintenance rule and the payment is $907.87 instead of the $1,233.94 independent living rate.

The SSA's Rental Rule fixes this. If the adult child pays monthly rent that equals or exceeds the Presumed Maximum Value threshold — $351.33 in 2026 — the SSA doesn't count the remaining shelter value as in-kind income. The individual becomes eligible for the full independent living rate.

To implement this:

  1. Draft a written landlord-tenant agreement between the parent and the adult child
  2. Set the monthly rent at $351.33 or, if lower, at the documented local fair-market value
  3. The adult child pays rent from their own funds (the SSI check), not from money the parent gave them
  4. Report the arrangement to the local SSA field office with a copy of the agreement

Once verified, the payment jumps from $907.87 to $1,233.94. The net effect after paying $351.33 rent is an additional $326.07 minus $351.33 in rent — wait, that looks like a loss. But the SSA is comparing the full independent living rate against the reduced household rate. The adult child pays $351.33 in rent and receives $326.07 more per month. The $25 "cost" of the rental arrangement is usually offset by the fact that the family was already supporting the adult child's food and shelter.

The real value: many families would have the adult child contribute toward household expenses anyway. Formalizing it as a rental agreement lets the SSA treat the living arrangement as independent rather than dependent.

Non-Medical Out of Home Care Rates

For adults living in licensed residential care facilities, the NMOHC rate of $1,626.07 applies. This payment is functionally allocated: $706.07 for room and board, up to $738 for care and supervision, and $182 for personal and incidental needs. The facility can charge the basic services rate of $1,444.07 plus $20 if the resident has other countable income.

Families considering residential placement should compare the total cost of the facility against the NMOHC rate plus any supplemental regional center funding. Some facilities charge significantly more than the SSI/SSP allowance covers, and the gap must come from other sources — regional center authorization, Medi-Cal waiver services, or family contributions.

Reporting Wages

SSI recipients who work must report their earnings to the SSA. The reporting window is the first 6 days of the month following the month wages were received. California offers multiple reporting methods:

  • SSI Telephone Wage Reporting: call the dedicated line
  • SSI Mobile Wage Reporting app: available for iOS and Android
  • mySSA online account: report through the SSA's website
  • In person: visit the local SSA field office

Timely reporting is critical. The SSA adjusts the monthly SSI payment based on earnings — if they don't know about income for several months, they overpay and then demand the excess back.

Keep copies of every pay stub and every wage report submission. If a discrepancy arises, documentation of what was reported and when is the fastest way to resolve it.

Handling Overpayments

SSI overpayments happen when the SSA paid more than the recipient was entitled to, usually because of unreported or late-reported income, changes in living arrangement, or resource limit violations. The SSA sends an overpayment notice showing the amount owed and the proposed repayment plan (typically a deduction from future SSI payments).

Three options when you receive an overpayment notice:

Request reconsideration — If you believe the overpayment amount is wrong (you reported wages on time, the living arrangement was correctly documented, etc.), file a reconsideration request within 60 days. The SSA will review its records.

Request a waiver — Even if the overpayment is correct, you can request a waiver if repaying would cause financial hardship and the overpayment wasn't your fault. "Not your fault" means you didn't misrepresent facts or fail to report changes — the error was on the SSA's side, or you misunderstood the rules despite acting in good faith.

Request a different repayment rate — If neither reconsideration nor waiver applies, you can ask SSA to reduce the monthly deduction amount if the standard deduction would cause hardship.

The worst outcome is ignoring the notice. Without a response, the SSA begins automatic deductions from the SSI payment, and the window for reconsideration or waiver shrinks.
