Why Costs Vary So Much Across Counties

Alabama has 67 county probate courts, and each probate judge has broad administrative discretion over local procedures — including what they charge. There's no statewide uniform fee schedule for guardianship filings. A family in one county might pay $30 to file. A family one county over might pay $1,500 before the first hearing even gets scheduled.

The base filing fee is only part of the picture. Some counties require a mandatory security deposit at the time of filing. Others add separate charges for the guardian ad litem appointment, court representative fees, or document processing. Understanding the full upfront cost before filing prevents a family from starting a process they can't afford to finish.

County-by-County Filing Fees

Here's what several of Alabama's larger county probate courts charge for guardianship filings, based on published fee schedules:

Jefferson County (Birmingham): $175 for a guardianship filing. The court operates across distinct Birmingham and Bessemer divisions, each with its own filing procedures. Jefferson County publishes a specific initial filing packet for adult guardianship and conservatorship cases.

Madison County (Huntsville): $37 for guardianship only, $64 for a combined guardianship/conservatorship filing. But the number that matters is the mandatory $1,500 security deposit required at filing. Total initial cash required: $1,537 to $1,623.

Mobile County: $30 base filing fee. Notably lower than most other large counties. But Mobile County strictly enforces the post-appointment Care Plan requirement — it's due within 45 days.

Lee County (Auburn/Opelika): $104 for guardianship, $218 for a combined guardianship/conservatorship petition. Strict timeline enforcement.

Houston County (Dothan): $93 filing fee plus a $1,500 security deposit. Total initial cash: $1,593 or more. Houston County also offers a specialized "Fast Track Guardianship" option at $365, which includes a $250 GAL fee — designed specifically for developmental disability transitions.

Dale County: $32 for guardianship, $52 for a combined filing. One of the lower-cost entry points in the state.

Baldwin County (Bay Minette/Gulf Shores): Published fee schedule available through the probate office website. Fees fall in the moderate range for the state.

The Costs Beyond Filing Fees

The filing fee is the starting line, not the finish line. The total cost of a guardianship proceeding in Alabama includes several additional components:

Guardian ad litem (GAL) fees: The court appoints an independent attorney to represent the alleged incapacitated person. This is mandatory, not optional. GAL fees typically range from $250 (Houston County's Fast Track includes this) to $1,000 or more depending on the complexity of the case and the county's fee structure.

Physician examination: A licensed physician must conduct a clinical examination and file a medical evaluation with the court. If the person doesn't have an existing relationship with a physician who can complete this evaluation, the family may need to pay for an independent evaluation — typically $300 to $800 depending on the provider.

Court representative investigation: The court appoints an investigator to interview the respondent and inspect their living arrangements. The cost for this investigation is typically charged to the petitioner or the estate.

Attorney fees: While pro se filing is legally permitted (using the AOC Form PS-11 for intellectual disability cases), most families retain an attorney. Attorney fees for an uncontested guardianship in Alabama generally range from $1,500 to $5,000. Contested cases — where the respondent, another family member, or the GAL objects — can cost substantially more.

Conservator surety bond: If the petition includes conservatorship (authority over financial assets), the conservator must purchase a corporate surety bond before exercising any authority. The bond amount equals the value of the ward's personal property plus one year of estimated income plus 10%. Bond premiums are an ongoing annual cost.

Total Cost Ranges

For an uncontested guardianship with attorney representation in a lower-cost county: $2,000 to $4,000 including filing fees, attorney fees, GAL, and physician evaluation.

For a combined guardianship/conservatorship in a county with a security deposit requirement: $4,000 to $8,000+ including the security deposit, surety bond, and all professional fees.

For a contested case where the respondent or family members object: $10,000+ when the case goes to a full evidentiary hearing with testimony from multiple parties.

Reducing Costs

File in the right county. Fees vary enough that it matters. The filing must go to the county where the alleged incapacitated person lives — you can't county-shop — but knowing the fee schedule in advance helps families budget.

Ask about the Fast Track option. Houston County's $365 inclusive program exists specifically for developmental disability transitions. Other counties may have similar expedited programs — ask the probate clerk.

Consider whether you actually need guardianship. The single biggest cost-saving strategy is determining that guardianship isn't necessary. A Colby Act supported decision-making agreement costs nothing to execute beyond notary fees. A durable power of attorney costs a few hundred dollars with an attorney, or nothing if the family uses the statutory form. An educational representative appointment through the school district is free.
