Georgia Probate Court Fees by County for Guardianship

Why County Matters More Than You Think

Georgia has 159 counties, and each probate court sets its own fee schedule for adult guardianship petitions. The base filing fee for GPCSF 12 is just one piece — counties bundle evaluator appointments, court-appointed attorney fees, sheriff service charges, and recording fees differently. The difference between the cheapest and most expensive counties can exceed $600.

This creates a real planning problem. A family in Clayton County faces roughly $853 in upfront bundled costs, while a family filing in Wayne County pays closer to $175 in base fees. Neither number is wrong — they just reflect how each county structures its probate court funding.

Metro Atlanta County Comparison

Fulton County operates one of the busiest probate courts in the state. The court offers "Walk-in Wednesdays" for families needing procedural guidance, which is unusual — most counties require scheduled appointments weeks in advance. Filing fees align with other metro counties, but Fulton requires fiduciaries to complete a court-produced instructional video before appointment.

Gwinnett County handles a high volume of guardianship petitions given its large population. Expect the standard GPCSF 12 filing fee plus separate charges for the court-appointed evaluator and attorney. The probate court maintains an active panel of approved evaluators, which generally speeds up the scheduling process compared to rural counties.

Cobb County follows a similar structure to Gwinnett. Filing fees cover the petition itself, with evaluator and attorney appointment fees billed separately. The court processes guardianship petitions on a regular calendar schedule.

DeKalb County mirrors the metro pattern — standard filing plus professional fees. Confirm the current total initial outlay with the DeKalb County Probate Court, because mandatory appointment charges may be added to the filing fee.

Suburban and Exurban Courts

Clayton County is one of the most expensive jurisdictions for guardianship petitions. The county bundles the filing fee, court-appointed evaluator, court-appointed attorney, and process server into a single upfront payment of approximately $853. This bundled approach eliminates the surprise of staggered bills, but the initial cash outlay is steep for families already stretched thin.

Forsyth County charges a baseline filing fee of approximately $205. Evaluator and attorney fees are billed separately as the case progresses. This unbundled structure means a lower initial payment, though the total cost still climbs as the court appoints professionals.

Henry County charges approximately $175.50 in base filing fees. Including evaluator and attorney appointments, the total initial cost reaches roughly $856 — nearly identical to Clayton despite the lower base fee.

Rural Counties

Filing fees in rural counties tend to be lower at the petition stage, but the practical costs can rise in other ways. Finding a clinician authorized under HB 36 to perform the mandatory pre-filing evaluation may require travel to a metro area. The clinician must examine the proposed ward within 15 days before filing, so geographic distance translates directly into scheduling pressure and transportation costs.

Wayne County charges approximately $175 in base filing fees — among the lowest in the state. Columbia County's base filing fee is about $493 for one petitioner; with the listed $200 Guardian ad Litem fee, an example total is about $693 (or $735 for two petitioners).

The Poverty Affidavit Option

If guardianship filing fees create genuine financial hardship, Georgia law provides a fee waiver mechanism. Under O.C.G.A. § 15-6-77, you can submit a Poverty (Pauper's) Affidavit with your petition. The affidavit requires verified income documentation — tax returns, pay stubs, and a detailed monthly expense breakdown. If the probate court grants the waiver, filing fees are reduced or eliminated entirely.

Not all counties process these affidavits quickly. Call your county probate court before filing to ask about their specific requirements and typical processing time.

What the Fees Actually Cover

The standard process includes the petition filing itself. If the court finds probable cause, it then requires personal service on the proposed ward by a sheriff or process server, appointment of a court-approved evaluator, and appointment of independent legal counsel for the proposed ward. Some counties roll these into one charge. Others bill each as a separate line item as the case progresses.

Beyond the initial costs, ongoing compliance creates additional expenses — annual reporting fees, surety bond premiums for conservators, and periodic court review fees. These post-appointment costs aren't reflected in the filing fee comparison but should factor into the total cost calculation.

Before committing to the guardianship process, explore whether less restrictive alternatives — powers of attorney, healthcare directives, supported decision-making agreements — could address the same practical needs at a fraction of the cost.
