DC Guardian Post-Appointment Requirements: Background Checks, Plans, and Reports
The Reporting Obligations Nobody Mentions Before Filing
Getting appointed as guardian in DC is the beginning of ongoing court supervision, not the end of a process. The Probate Division imposes strict post-appointment deadlines, and missing any of them can lead to court enforcement action, including possible removal as guardian.
Most families are blindsided by the scope of what comes after the appointment order. Here's the full timeline.
Mandatory Deadlines After Appointment
Within 60 days — Metropolitan Police Department background check. The appointed guardian must obtain a local criminal history check from MPD and file it with the court. This applies even if you're the parent and even if you submitted a Statement of Criminal History with the original petition.
Within 90 days — Guardianship Plan. A formal document filed with the Probate Division detailing your plans for the ward's care, living arrangements, medical treatment, education, social activities, and any services you intend to arrange. The plan must be comprehensive enough for the court to evaluate whether you're exercising your authority within the scope of the order.
Within 180 days — FBI fingerprint check. A federal-level background screening that requires scheduling an appointment at an approved fingerprinting location, submitting the prints to the FBI, and filing the results with the court. This is separate from the MPD check and covers nationwide criminal history.
Every 6 months — Report of Guardian. A verified (sworn) report filed on the anniversary cycle of your appointment date. The report must document the ward's current living situation, medical condition, services received, and any changes since the last filing. "Verified" means signed under oath.
If You're Also a Conservator
Conservators face additional financial reporting obligations on top of the guardianship requirements:
- Inventory and Conservatorship Plan within 90 days — A complete accounting of all assets, accounts, income sources, and a plan for managing them
- Annual financial accounting within 30 days of the anniversary — A detailed ledger of all transactions, receipts, and disbursements during the reporting period
The annual accounting must be precise enough for court review. Discrepancies between reported assets and actual holdings trigger investigations.

What Happens When You Miss a Deadline
The Probate Division monitors compliance. When a report or plan isn't filed on time, the court can require compliance and may take further action, including removal as guardian.
Some families hire an attorney specifically to handle the semi-annual reports, at $500 to $1,000 per filing, because the documentation requirements are detailed enough to justify professional help.
Court-Appointed Professionals Stay Involved
The appointment order doesn't end the involvement of court-appointed actors. The Guardian ad Litem, Visitor, or Examiner may be asked to conduct follow-up evaluations. If any interested party (a family member, social worker, or the ward themselves) raises concerns about the guardian's conduct, the court can order a new investigation at any time.
The ward also retains the right to petition the court independently — or through court-appointed counsel — to limit the guardian's powers, expand their own autonomy, or terminate the guardianship entirely.
Why This Matters Before You File
These ongoing obligations are the reason D.C. policy favors less restrictive alternatives. An SDMA requires no court reporting. A Durable Power of Attorney has no semi-annual filing obligations. An OSSE Educational Representative appointment doesn't trigger background check requirements.
