The Redetermination Is Not a Renewal

When a child receiving SSI turns 18, the Social Security Administration does not simply renew their benefits. It conducts a full, de novo medical redetermination, evaluating the young adult under a completely different set of criteria than the ones that originally qualified them.

This distinction matters because the childhood standard measures whether a disability causes "marked and severe functional limitations" relative to other children the same age. The adult standard asks a fundamentally different question: can this person engage in Substantial Gainful Activity (SGA)? That is, can they perform work that earns at least $1,690 per month in 2026?

About one-third of childhood SSI recipients are found ineligible under the adult criteria. For Kansas families, a denial does not just mean losing the monthly SSI check. It can cascade into loss of KanCare Medicaid and suspension of HCBS waiver standing, because Kansas requires a separate Medicaid application that depends on disability status.

When and How the Redetermination Happens

The SSA initiates the redetermination within the 12 months following the beneficiary's 18th birthday. The local field office schedules an eligibility interview (in person or by phone) and requests two critical forms:

• Form SSA-3368 (Disability Report for Adults): This captures the individual's medical conditions, daily functioning, work history, and limitations under the adult vocational framework.
• Form SSA-827 (Authorization to Disclose Information): This authorizes the SSA to collect medical, school, and treatment records from providers.

The case is then forwarded to Kansas Disability Determination Services (DDS), which conducts the medical evaluation. DDS may arrange consultative examinations if existing records are insufficient.

How to Prepare Before the Interview

The single most impactful thing families can do is assemble comprehensive medical evidence before the redetermination begins. The adult standard is clinical and vocational, so the evidence must go beyond a diagnosis and demonstrate how the disability limits the ability to work.

Collect recent records from every provider: psychiatrists, neurologists, therapists, behavioral health specialists. Functional assessments from school IEPs and transition programs are also relevant, especially documentation of adaptive behavior deficits, personal care needs, and supported decision-making requirements.

If the individual is enrolled in a vocational rehabilitation program or has an active IEP, notify the SSA field office immediately. This matters for Section 301 protection, discussed below.

What Happens If the Redetermination Denies Benefits

If DDS issues an unfavorable determination, the beneficiary receives a written cessation notice. SSI payments will terminate after the month of the determination plus two grace months.

The four levels of appeal are:

1. Reconsideration — File Form SSA-789 within 60 days. For medical cessations, this involves an informal face-to-face hearing before a Disability Hearing Officer (DHO), where the beneficiary can submit new evidence and bring witnesses.
2. Administrative Law Judge (ALJ) hearing — If reconsideration fails, request a formal hearing within 60 days. Kansas ALJ offices are located in Wichita and Overland Park.
3. Appeals Council review — A further 60-day window to request review by the SSA Appeals Council.
4. Federal District Court — The final administrative option.

The 10-Day SBC Deadline

This is the deadline most Kansas families miss.

To keep SSI payments and Medicaid active during the appeal, the beneficiary must request Statutory Benefit Continuation (SBC) using Form SSA-792. The catch: the SBC election must be submitted within 10 days of receiving the cessation notice. Federal rules assume the notice is received five days after mailing, so the practical window is about 15 days from the date printed on the letter.

If the SBC request is filed on time, cash benefits and Medicaid continue throughout the appeal. If it is filed after 10 days but within 60 days, the appeal still proceeds, but benefits stop during the process.

If the appeal is ultimately unsuccessful, benefits received during SBC may be assessed as an overpayment. The beneficiary can request a waiver of that overpayment based on financial hardship and good faith.

Section 301: Benefits Through Education or Vocational Programs

Even if the redetermination finds that the individual has medically improved, SSI payments can continue under Section 301 of the Social Security Act. This provision applies when the beneficiary is actively participating in an approved program before the month the disability is determined to have stopped.

Approved programs include:

• An active Individualized Education Program (IEP) for youth aged 18 through 21
• A state Vocational Rehabilitation program with a signed Individualized Plan for Employment
• An approved Plan to Achieve Self-Support (PASS)

The beneficiary or representative payee must proactively submit proof of enrollment, such as the IEP signature page or the VR plan, when the redetermination begins. SSA claims representatives do not always identify Section 301 eligibility on their own.

If the IEP ends, a transition to a state VR program must occur within 90 days to maintain uninterrupted Section 301 protection.

The Kansas-Specific Cascade

In most states, losing SSI at 18 means losing cash benefits. In Kansas, the consequences run deeper because the state does not automatically link SSI to Medicaid. If SSI is denied and no appeal preserves benefits, the individual loses their disability status for KanCare purposes. That means Medicaid coverage lapses unless a separate eligibility pathway is established, which in turn suspends any HCBS waiver services or waiting list position.
