Idaho Emergency Guardianship: When and How to File for Temporary Authority

A standard guardianship proceeding in Idaho takes 60 to 90 days from petition to hearing. When a young adult with a disability faces an immediate crisis — a medical provider refusing to treat them, a sudden housing eviction, financial exploitation in progress — that timeline is dangerously slow. Idaho Code § 15-5-310 provides an expedited path: the emergency (temporary) guardianship appointment.

When Emergency Guardianship Applies

The court can appoint a temporary guardian when there is substantial evidence of incapacity and an emergency likely to cause immediate and substantial harm to the respondent's health, safety, or welfare, and no other person appears able, authorized, and willing to act. Common triggers for families of young adults with disabilities include:

  • A healthcare provider refuses to administer urgent treatment because no one has legal authority to consent
  • The young adult is being financially exploited and assets are being drained in real time
  • An unsafe housing situation creates immediate physical danger
  • A psychiatric crisis requires institutional placement that the young adult cannot consent to

The key threshold is immediacy. The court must find that the danger is present or imminent — not theoretical, not "might happen in six months." If the concern is about long-term planning, the standard guardianship process is the appropriate path.

How the Emergency Filing Works

An emergency guardianship petition is filed alongside (or as a companion to) the standard Petition for Appointment of Guardian. You are essentially asking the court to appoint a temporary guardian now while the full proceeding continues on its normal 60-to-90-day track.

The court can hold an expedited hearing and may appoint a temporary guardian with limited authority specific to the emergency. The order typically grants authority only over the specific area of crisis (medical decisions, residential placement, financial protection) rather than broad guardianship powers.

Duration and Limitations

A temporary guardianship order under Idaho Code § 15-5-310 has a statutory expiration. For an adult, the temporary guardian's authority may not exceed 90 days unless extended for good cause. It provides a bridge while the full proceeding works through its required steps — court visitor investigation, respondent's counsel consultation, notice to interested parties, and evidentiary hearing.

The temporary guardian's authority is intentionally narrow. The court defines exactly what decisions the temporary guardian can make, and any authority beyond the scope of the emergency order requires the full proceeding to conclude.

The Respondent's Rights During an Emergency

Even in an emergency appointment, the respondent retains constitutional protections:

  • The right to court-appointed client-directed counsel
  • The right to contest the temporary appointment
  • The right to request a hearing to modify or dissolve the temporary order
  • Protection from any authority broader than what the emergency specifically requires

The court cannot use an emergency appointment as a shortcut to avoid the full UGCOPAA requirements. The standard proceeding — including the Physician's Certificate, court visitor investigation, and evidentiary hearing — still runs on its normal timeline in the background.

Better Than Emergency: Plan Ahead

Most families who end up in emergency guardianship court had months of warning signs they did not act on. The transition from minor to adult at 18 is predictable, and every tool that avoids the emergency scenario is available before the crisis arrives:

  • Execute an Advance Care Planning Document promptly after the young adult turns 18 to prevent healthcare access lockouts
  • Set up a durable financial power of attorney while the young adult has clear capacity to sign
  • Apply as representative payee through the SSA before SSI benefits transfer to adult rules
  • If guardianship will be necessary, start the standard filing process 2 months before the 18th birthday so the order is in place at the transition point
