504 Plan for ADHD in Arizona: Accommodations, Eligibility, and What Schools Must Provide

Your child has an ADHD diagnosis and the school has mentioned a "504 plan" — or maybe they haven't mentioned it at all and you're trying to figure out if your child is entitled to something. Here is the Arizona-specific picture: what a 504 plan actually provides for ADHD, when an IEP is the better choice, and what Arizona schools are required to do.

ADHD and 504 Eligibility in Arizona

ADHD almost always qualifies under Section 504 of the Rehabilitation Act as a physical or mental impairment that substantially limits major life activities — specifically learning, concentrating, reading, and executive function tasks. The bar for 504 eligibility is significantly lower than IEP eligibility. You do not need to show that the ADHD requires specially designed instruction — only that it substantially limits a major life activity.

Arizona school districts use their own 504 evaluation procedures. There is no statewide Arizona regulation governing 504 timelines the way A.A.C. R7-2-401 governs IEP timelines. In practice, districts vary widely in how quickly they process 504 requests and what their evaluation process looks like. A medical diagnosis of ADHD from a pediatrician or psychiatrist should be sufficient supporting documentation in most Arizona districts.

504 vs. IEP for ADHD: The Decision That Matters

A 504 plan provides accommodations — adjustments to how your child takes tests, how materials are presented, how the environment is structured. It does not provide specialized instruction or services delivered by specialists.

An IEP under the Other Health Impairment (OHI) category provides everything a 504 provides plus:

  • Specially designed instruction (the teacher changes the how, not just the conditions)
  • Related services: speech therapy, occupational therapy, counseling
  • A resource room placement if needed
  • A BIP and FBA if behavioral issues are present

Arizona has an elevated Specific Learning Disability (SLD) identification rate — 40% versus the national average of 33%. Many children who present primarily as ADHD also have co-occurring SLDs (dyslexia, dyscalculia, language processing disorders) that are not identified without a full psychoeducational evaluation. If your child's ADHD presentation includes significant academic failure despite extended time and other accommodations, a formal evaluation for SLD is appropriate even if the district is satisfied with a 504.

Standard 504 Accommodations for ADHD in Arizona

A well-written 504 plan for ADHD typically includes:

Testing accommodations:

  • Extended time (typically 50% to 100% additional time on timed assessments)
  • Testing in a separate, low-distraction setting
  • Breaks during extended assessments
  • Reading of test questions aloud (for processing issues)

Classroom accommodations:

  • Preferential seating near the teacher, away from high-distraction areas
  • Chunked assignments with intermediate check-ins
  • Assignment notebooks or electronic planners checked by teacher
  • Reduced volume on homework (same learning targets, fewer repetitions)
  • Verbal and written instructions provided simultaneously
  • Permission to use noise-canceling headphones during independent work

Behavioral and organizational:

  • Access to movement breaks
  • A private signal system between student and teacher
  • Check-in/check-out (CICO) with a trusted adult
  • Copies of notes or teacher-provided outlines

A 504 plan that lists only "extended time" and "preferential seating" for moderate-to-severe ADHD is inadequate. If your child's symptoms affect multiple areas of school functioning, the 504 should reflect that comprehensively.

ADHD Accommodations in IEPs: What's Different

If your child has an IEP under OHI for ADHD, accommodations are embedded in the IEP document and are legally enforceable in the same way as service minutes. In addition to all the accommodations a 504 provides, an IEP can include:

  • Specially designed instruction in executive function skills (not just "preferential seating" but explicit instruction in planning, organization, task initiation)
  • Counseling services from a school social worker or psychologist focused on ADHD self-regulation
  • A behavioral aide or paraeducator for specific periods
  • Modified grading practices for classwork (not standardized assessments) when appropriate

Arizona schools sometimes steer ADHD families toward a 504 even when the child's needs clearly require an IEP. If the school is proposing a 504 and your child is failing multiple subjects, has been suspended for behavioral incidents, or requires a paraeducator to access instruction, request a formal IEP evaluation in writing.

Charter Schools and 504 Plans

Arizona charter schools must offer formal 504 plans. A charter school that tells you it provides "informal supports" instead of a 504 plan is not in compliance with Section 504. This is a common issue in the Phoenix metro area.

If a charter school refuses to develop a 504 plan, denies your request without a legitimate evaluation process, or fails to implement the plan's accommodations, you can file a complaint with the U.S. Department of Education's Office for Civil Rights, Denver office, which has jurisdiction over Arizona. OCR complaints are free and do not require an attorney.

How to Request a 504 in Arizona

Submit a written request to the principal and the school's 504 coordinator (usually the principal or a designated administrator — not the special education coordinator, who handles IEP-related matters). In your request, state that your child has been diagnosed with ADHD and that you are requesting a formal 504 evaluation and plan.

Keep a copy of the email. Follow up if you don't hear back within two weeks. If the district refuses to evaluate or implement a plan after a reasonable period, OCR is your next step.
